Our Terms and Conditions
Flexi Containers LTD · Effective date: 12 July 2026.
Updated: 09 August 2026.
These terms apply to every sale and rental of shipping containers, and any related delivery, collection or modification services, supplied by Flexi Containers LTD. Please read them carefully before placing an order. By placing an order or paying a deposit, you agree to be bound by them.
1. About Us
Flexi Containers LTD (“we”, “us”, “our”) is a company registered in England and Wales, company number 07121937, with its registered office at Oxford Chambers, Oxford Road, Guiseley, Leeds, LS20 9AT, UK. [VAT number: [VAT number].]

“You” means the person or business placing the order. A “Consumer” is an individual acting wholly or mainly outside their trade, business or profession. A “Business Customer” is anyone else.
2. Our Contract With You
2.1 Product listings, photos, descriptions and prices on our website are an invitation to order, not an offer. Your order is an offer to us.
2.2 A contract is formed only when we confirm your order in writing (usually by email) or when we dispatch the container, whichever happens first.
2.3 We may decline an order, for example if a container is out of stock, a price was shown in error, or we cannot deliver to your location. If we have taken payment for an order we decline, we will refund it in full.
2.4 Please check your order confirmation carefully and tell us immediately of any errors. These terms, your order confirmation, and (for rentals) any rental agreement form the whole agreement between us. If they conflict, the rental agreement prevails for rentals.
2.5 Container dimensions are nominal. Standard shipping containers may vary slightly from the stated size. Photos may show a similar unit, not the exact container supplied, unless we confirm otherwise in writing.
3. Prices and Payment
3.1 All prices are in pounds sterling. Prices include VAT where stated; otherwise VAT is added at the prevailing rate. Delivery is charged separately unless the listing says otherwise.
3.2 We may require a deposit, or payment in full, before we dispatch or reserve a container. Unless agreed in writing, the balance of the price is due before delivery.
3.3 We accept payment by the methods shown at checkout or on our invoice. Containers will not be released until cleared funds are received.
3.4 If you are a Business Customer and do not pay an invoice by its due date, we may charge interest at the rate set by the Late Payment of Commercial Debts (Interest) Act 1998, plus reasonable recovery costs, and may suspend further deliveries or collect rented containers.
3.5 Prices may change before we confirm your order. Once confirmed, the price for that order will not increase, except where delivery costs change because you change the delivery location or access arrangements.
4. Condition and Grade of Containers
4.1 Containers are sold by grade (for example New / One-Trip, Wind and Watertight, Cargo Worthy, or As Is). The grade shown in the listing or confirmation applies.
4.2 Used and one-trip containers are not new. Dents, scratches, surface rust, paint wear and minor marks are normal and do not make a container defective unless they fall outside the stated grade.
4.3 Containers sold As Is are sold in their visible condition. You are encouraged to request photos or inspect the actual unit before buying.
4.4 Containers are supplied as shipping containers. Unless we have agreed in writing, they are not insulated, fire-rated, or suitable for habitation or storage of hazardous, perishable or regulated goods.
5. Delivery and Collection
5.1 Delivery is by lorry (usually with a tilt-and-slide or crane-offload vehicle). Delivery dates and times are estimates and are not guaranteed. We will notify you of the delivery window where possible.
5.2 Site access is your responsibility. You must make sure that the delivery location is safe, level, firm, and reachable by a large vehicle, with enough width, overhead clearance (including trees, wires and gates) and turning space. We recommend you confirm this before ordering, and we may ask for photos or measurements.
5.3 You, or someone aged 18+ you authorise, must be present to receive the container. The driver’s decision on whether a site is safe is final.
5.4 If delivery or collection cannot go ahead because of poor access, ground conditions, an unsuitable site or no one being available, we may charge a failed delivery fee and a re-delivery charge.
5.5 We are not responsible for damage to driveways, paving, lawns, drains, utilities or other property caused by delivery vehicles or the placing of a container on unsuitable or unmarked ground, unless caused by our negligence.
5.6 We are not liable for delays caused by events outside our reasonable control (see Section 13). If we cannot deliver on the agreed date, we will contact you to rearrange. If the new date does not suit you, you may cancel and receive a full refund of amounts paid.
6. Ownership and Risk (Sales)
6.1 Risk in the container passes to you when it is delivered (or when you, or someone for you, collects it).
6.2 Ownership passes to you only when we have received full payment of all amounts due for it. Until then, we may enter your premises to recover the container, and you must keep it insured, undamaged and identifiable.
6.3 You are responsible for ensuring the container is positioned legally and safely, and for any planning permission, building regulation approval, landlord or freeholder consent, or other licence needed (see Section 9).
7. Container Rentals
7.1 Ownership. Rented containers remain our property at all times. You must not sell, lend, sub-let, move, modify or part with possession of a rented container without our written consent.
7.2 Term and notice. The minimum rental term is one month unless your rental agreement says otherwise. Rental continues until the container has been collected. You must give at least 14 days’ written notice to end a rental.
7.3 Care of the container. You must keep the container in good condition, locked when unattended, and use it only for lawful purposes. You must not drill, cut, weld, paint or otherwise alter it, or stack, tow or move it, without our written consent.
7.4 Risk and insurance. You bear the risk of loss, theft and damage from delivery until we collect the container. We strongly recommend you insure both the container and its contents. We do not insure your goods.
7.5 Collection. The container must be empty, clean and accessible on the agreed collection date. If we cannot collect because it is blocked, inaccessible or not emptied, we may charge additional rental and re-collection fees.
7.6 Damage and deposits. You are liable for damage beyond fair wear and tear, loss and theft, and for cleaning. These costs may be deducted from your security deposit, with any shortfall invoiced to you. Deposits are refunded within 14 days of collection and inspection, less any deductions.
7.7 Rent increases. For rentals continuing beyond the initial term, we may adjust rental rates on 30 days’ written notice. If you do not agree, you may end the rental in line with clause 7.2.
7.8 Our right to terminate. We may end a rental and collect the container immediately if you fail to pay, breach these terms, misuse the container or store prohibited items. You remain liable for sums due up to collection.
8. Cancellations, Returns and Refunds
8.1 Cancellations, returns and refunds are governed by our Returns, Cancellations & Refunds Policy, which forms part of these terms.
8.2 If you are a Consumer, you have a statutory right to cancel most distance and off-premises purchases within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, as explained in that policy. This right does not apply to goods made to your specification, including custom or modified containers.
8.3 Nothing in these terms affects your legal rights under the Consumer Rights Act 2015.
9. Your Responsibilities and Safe Use
9.1 Planning and permissions. You are solely responsible for finding out whether planning permission, building regulations approval, or permission from a landlord, freeholder, or local authority is required to place or use a container on your land. We do not give planning advice, and a lack of permission is not a reason for return or refund.
9.2 Lawful and safe use. You must use the container lawfully and safely. You must not store hazardous, flammable, explosive, illegal, stolen or perishable goods in it, or allow people to live or work inside it unless it has been properly converted and approved for that use.
9.3 Ventilation and condensation. Steel containers can suffer from condensation and temperature extremes. You are responsible for choosing suitable storage conditions, ventilation and protection for your goods.
9.4 Security. You are responsible for the security of the container and its contents. We recommend you fit a suitable lock or lock box and check your insurance cover.
9.5 Handling. Containers are heavy. Do not attempt to lift, tow, stack or move a container unless you are suitably qualified and equipped. Take care when opening and closing doors, particularly in windy conditions.
10. Custom and Modified Containers
10.1 Modifications (such as added doors, windows, cut-outs, insulation, electrics, shelving or paint) are made to your agreed specification and are subject to a written quote.
10.2 Lead times are estimates. Once work has started, the order cannot be cancelled and any deposit is non-refundable, unless the work is faulty or does not match what was agreed in writing.
10.3 Modification can change a container’s structural properties and stackability. Any structural or electrical work you commission from third parties after delivery is at your own risk.
11. Our Liability
11.1 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded. Nothing limits a Consumer’s statutory rights.
11.2 Subject to clause 11.1, we are not liable for:
- loss of or damage to goods stored in a container (Business Customers and Consumers alike should insure stored goods).
- loss of profit, revenue, business, or goodwill (Business Customers).
- indirect or consequential loss, or any loss that was not a reasonably foreseeable result of our breach.
- damage to your property caused by unsuitable site conditions or by the placing, lifting, or collection of a container where you have not given accurate access information.
11.3 Subject to clause 11.1, our total liability to a Business Customer for any claim relating to an order is limited to the price paid for that order (or, for rentals, the rent paid in the 12 months before the claim).
11.4 We supply containers for personal and business use only within the normal purposes of shipping containers. We do not accept liability if a container is used for any other purpose, or in breach of these terms.
12. Business Customers
12.1 If you are a Business Customer, the statutory consumer cancellation rights do not apply to you, and these terms (together with any order confirmation and rental agreement) apply in full.
12.2 Implied terms as to satisfactory quality and fitness for purpose are excluded to the fullest extent permitted by law, except for those that cannot be excluded.
13. Events Outside Our Control
We are not in breach of these terms, and are not liable for delay or failure to perform, if caused by an event beyond our reasonable control. This includes severe weather, flood, fire, industrial action, supply chain or shipping disruption, port delays, road closures, epidemic, war, terrorism, or government action. We will contact you promptly and take reasonable steps to carry out our obligations. If the delay continues for more than 30 days, either party may cancel the affected order, and we will refund sums paid for goods or services not delivered.
14. Personal Information
We collect and use your personal information to process your order, arrange delivery and collection, take payment, and comply with legal obligations, in line with UK data protection law. Details of what we collect, why, how long we keep it, and your rights are set out in our Privacy Policy. We will not sell your personal information.
15. Website and Intellectual Property
15.1 All content on our website, including text, photos, logos and design, belongs to us or our licensors. You may view and print pages for personal use but must not copy, reproduce or use them commercially without our written permission.
15.2 We try to keep our website accurate and available but do not guarantee it will be error-free or uninterrupted. Product images are illustrative.
15.3 If you give us photos or designs for a custom order, you confirm you have the right to use them and will compensate us for any claim arising from our use of them as you instruct.
16. Complaints
We want to put things right. If you have a complaint, please email sales@flexicontainersltd.com or call +44 7762 079692, quoting your order number. We aim to acknowledge complaints within 2 business days and to resolve them within 14 days. If we cannot resolve your complaint, Consumers may use an alternative dispute resolution provider, and we will tell you which one is available if this applies.
17. General
17.1 Changes to these terms. We may update these terms from time to time. The version in force when you place your order applies to that order.
17.2 Transfer. You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to another business, provided your rights are not reduced.
17.3 Notices. Notices to us must be sent by email to sales@flexicontainersltd.com or by post to our registered address. We may contact you using the details you gave when ordering.
17.4 Severability. If any part of these terms is found invalid or unenforceable, the rest remains in force.
17.5 No waiver. If we do not enforce a right straight away, that does not mean we have given it up.
17.6 Third parties. Only you and we have rights under this contract. Nobody else may enforce it under the Contracts (Rights of Third Parties) Act 1999.
17.7 Governing law. These terms and any dispute arising from them are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that Consumers living elsewhere in the UK may bring proceedings in their local courts.
